These Terms of Service (“Terms”) are between you and Interwebx LLC, a Florida limited liability company and operator of PlayGoOn (“PlayGoOn,” “we,” “us,” or “our”). They govern access to and use of PlayGoOn’s websites, mobile applications, software, communications, and related services (collectively, the “Service”).

These Terms become effective on the publication date shown above. When PlayGoOn presents legal documents for a feature or role, users must separately accept the then-current Terms, Community Guidelines, and Participant Risk Acknowledgment and Liability Waiver and separately acknowledge the then-current Privacy Policy before using the affected participation features. Trainers and Clubs must also accept their then-current applicable platform agreement.

1. Eligibility

You must be at least 18 years old, have reached the age of legal majority where you live, and be legally capable of entering a contract to use the Service. Minor accounts and youth participation are not supported in this release. When PlayGoOn requests date of birth for an age-restricted feature, PlayGoOn determines adult eligibility before making the affected feature available. You may not use the Service if applicable law prohibits you from receiving it or if PlayGoOn previously suspended or terminated your account for serious or repeated violations.

If you use the Service for a club, trainer business, employer, organization, or other entity, you represent that you have authority to bind that entity. “You” then includes both you and that entity.

2. What PlayGoOn provides

PlayGoOn helps adults discover sports, courts, clubs, trainers, groups, games, tournaments, and other activities; create or join activities; communicate with other users; and manage sports-related profiles and listings.

Unless PlayGoOn expressly states otherwise in a separate written agreement:

• PlayGoOn is a technology platform and is not the activity organizer, sports club, facility operator, trainer, medical provider, safety supervisor, employer, agent, insurer, or transportation provider.
• Users, trainers, clubs, facilities, and organizers are independent parties. They control their own activities, services, availability, prices, rules, qualifications, facilities, and conduct.
• Those independent parties remain responsible for activity safety and their respective legal and operational obligations.
• A profile, badge, credential notation, approval, or search position is not a warranty that a person, club, facility, activity, or service is safe, licensed, insured, qualified, accurate, available, or suitable.
• PlayGoOn does not guarantee that games will occur, facilities will be available, users will attend, or any participant will perform at a stated skill level.

3. Accounts and account security

You must provide accurate, current, and complete information and keep it updated. You may maintain only accounts permitted by the Service. You may not impersonate another person, create a deceptive identity, sell or transfer an account, or allow unauthorized access.

You are responsible for safeguarding credentials and for activity under your account. Notify support@playgoon.com promptly if you suspect unauthorized access. We may require reasonable proof of account ownership or representative authority before restoring access or approving a Trainer or Club role. Initial-beta Trainer onboarding does not require government-issued identity documents.

4. Profiles, listings, games, groups, and communications

You are responsible for information you publish, including your name, photo, biography, sports, skill level, availability, prices, credentials, Club information, court details, game details, messages, comments, and uploaded materials (“User Content”).

You agree that:

• information you provide will be truthful and not misleading;
• activity details will identify material rules, costs, eligibility requirements, accessibility limits, and cancellation terms;
• you will not misrepresent credentials, ownership, affiliation, skill, identity, facility access, or authority;
• you will communicate respectfully and only for legitimate platform purposes;
• you will not use contact information obtained through PlayGoOn for spam, harassment, scraping, resale, surveillance, or unrelated solicitation; and
• you will comply with facility rules and applicable law.

Game creators, group administrators, tournament organizers, trainers, and Club representatives may establish reasonable participation rules consistent with these Terms. They may remove participants for safety, misconduct, nonpayment outside PlayGoOn, capacity, eligibility, or rule violations. They may not discriminate unlawfully or misuse their role.

5. Location information and maps

The Service may use Google Maps, Google Places, an address, approximate location, device location, map pin, court coordinates, availability or slot coordinates, or distance preference to show activities and facilities or coordinate play. Device location requires permission where required by the operating system or law. Precise coordinates may be stored and shown to signed-in users when the feature and applicable product rules allow it.

Do not use PlayGoOn to track another person, expose a private residence without authorization, or publish a sensitive location. Map data, travel times, distances, facility details, and directions may be incomplete or inaccurate. Confirm destinations and conditions independently.

6. Trainers

A Trainer is responsible for maintaining all licenses, certifications, insurance, permits, tax registrations, background checks, and other qualifications required for the Trainer’s services. Trainers must provide accurate credentials and promptly update expired, suspended, revoked, or changed credentials.

When a person applies as a Trainer, PlayGoOn may collect application details, date of birth for adult eligibility, qualification or certification information, qualification evidence, and the applicant’s separate legal actions. Every Trainer applicant must provide at least one qualification document, and Trainer approval requires PlayGoOn to accept at least one qualification document. Formal certification is optional, but an applicant who claims a certification must provide evidence supporting that claim. Initial-beta Trainer onboarding does not request or collect government-issued identity documents.

Qualification evidence is kept in private, access-controlled storage and screened for malware before ordinary application review. Evidence identified as unsafe or unsuitable for review may be rejected or isolated while PlayGoOn addresses the security issue. Access is limited to specifically authorized PlayGoOn personnel or contractors who need it for application review, security, support, or legal compliance and who are subject to confidentiality and least-privilege requirements. PlayGoOn controls application approval. An application, qualification document, certification claim, screening result, or approval does not guarantee competence, character, safety, legal compliance, or future conduct. Users must use independent judgment before hiring or meeting a Trainer.

Trainers are independent businesses and not PlayGoOn employees, workers, partners, franchisees, or agents. Trainers control how they provide their services, subject to law, facility rules, their agreements with customers, and the Trainer Platform Agreement.

7. Clubs and facilities

Club representatives must have authority to create and maintain a Club listing. Only Founding Clubs invited or approved by PlayGoOn may activate a public Club listing during Early Access. Founding Clubs receive a working Early Access service and are not represented as software testers.

Clubs are responsible for facility safety, accessibility, staffing, permits, insurance, court availability, pricing, reservation rules, emergency procedures, and information published through the Service. PlayGoOn’s approval or display of a Club does not mean PlayGoOn owns, operates, inspects, or guarantees the facility. Unless a separate written agreement says otherwise, reservations and payments made through an external Club system are governed by the Club’s terms and privacy practices.

8. Physical activity; health and safety

Sports and in-person meetings involve inherent risks, including falls, collisions, overexertion, equipment failure, facility conditions, weather, travel, communicable illness, property loss, serious injury, disability, and death.

You are responsible for deciding whether you are able to participate safely. Consider obtaining medical advice before beginning an activity, especially if you have a health condition, injury, pregnancy, medication issue, or other concern. Stop participating and seek appropriate help if you experience symptoms or unsafe conditions. PlayGoOn does not provide medical advice or emergency services.

For emergencies, contact local emergency services. Do not rely on PlayGoOn messages, reports, or support channels for urgent assistance. Before joining an Activity, participants must separately accept the then-effective Participant Risk Acknowledgment and Liability Waiver through an explicit acceptance action.

9. User Content license and responsibilities

You retain ownership of User Content. You grant PlayGoOn a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for formatting and accessibility, display, distribute, and otherwise use User Content only as reasonably necessary to operate, secure, improve, and promote the Service and the content or listing you chose to publish. This license ends when the content is deleted from active systems, except for reasonable backup retention, legal obligations, safety records, and content shared with others that they have not deleted.

You represent that you own or have permission to use your User Content and that our permitted use will not violate privacy, publicity, intellectual-property, contractual, or other rights. Do not upload government-issued identification or other sensitive personal records through ordinary profile or messaging features.

10. Prohibited conduct

You may not:

• threaten, stalk, harass, exploit, defraud, or endanger anyone;
• engage in sexual misconduct, hate-based conduct, unlawful discrimination, or credible threats;
• publish another person’s private information without authorization;
• create fake games, fraudulent listings, misleading reviews, or false credentials;
• arrange illegal gambling, match fixing, prohibited wagering, or unlawful activity;
• buy, sell, or distribute controlled substances, weapons, counterfeit goods, or unlawful services;
• scrape, harvest, index, copy, or commercially exploit the Service except through authorized interfaces;
• probe, scan, bypass, disrupt, overload, reverse engineer, or gain unauthorized access to the Service;
• introduce malware or use automation to create accounts, send spam, manipulate rankings, or evade enforcement;
• use the Service to train or build a competing dataset or model where prohibited by law;
• infringe intellectual-property rights; or
• assist another person in doing any of these things.

11. Early Access, fees, payments, cancellations, and taxes

PlayGoOn Early Access has no fixed end date and is currently free. PlayGoOn does not process activity, Club, or Trainer payments in the current release, and no platform, Club, or Trainer fees are collected through the Service.

PlayGoOn may modify, suspend, or discontinue Early Access or any feature. Paid plans or optional premium features may be introduced later only with at least 30 days’ advance notice. Before any charge, the applicable user, Trainer, or Club must expressly agree to the plan, price, billing frequency, renewal terms, and cancellation terms. Participation in free Early Access does not authorize PlayGoOn to charge a payment method automatically.

Independent Clubs, Trainers, facilities, and organizers may use external systems and are responsible for their own prices, taxes, payments, cancellation policies, refunds, and disclosures. A future PlayGoOn payment feature would require updated terms and an accepted payment addendum before use.

12. Third-party services

The Service may link to maps, booking systems, external payment providers, social networks, Club websites, or other third-party services. Their terms and privacy policies govern their services. PlayGoOn does not control and is not responsible for third-party content, security, availability, transactions, or practices.

13. Intellectual property

The Service, excluding User Content, is owned by Interwebx LLC or its licensors and protected by intellectual-property law. PlayGoOn grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for its intended purpose while these Terms remain in effect.

“PlayGoOn,” related logos, and product names are trademarks or trade dress of Interwebx LLC. These Terms do not grant permission to use them except as necessary to identify the Service truthfully.

14. Copyright complaints

Copyright concerns may be sent to support@playgoon.com with identification of the copyrighted work, the material at issue and its location, contact information, a good-faith statement, an accuracy and authority statement under penalty of perjury, and a physical or electronic signature. We may remove content and terminate repeat infringers where appropriate.

This is a general copyright-complaint channel. PlayGoOn does not represent it as notice to a registered Digital Millennium Copyright Act agent or as a substitute for any formal process required by law.

15. Moderation and enforcement

We may investigate reports and use automated or manual systems to detect misconduct. We may warn users; limit visibility or features; remove content; cancel activities; withhold or remove badges; require additional account, authority, or eligibility information; suspend or terminate accounts; preserve evidence; or report matters to Clubs, providers, law enforcement, or other appropriate parties when permitted by law.

We are not obligated to monitor every activity or communication and cannot guarantee that we will detect or prevent all misconduct. Enforcement decisions may consider severity, context, evidence, history, safety, and legal obligations. Non-emergency safety reports and appeals may be sent to support@playgoon.com.

16. Suspension and termination

You may stop using the Service at any time and request account deletion by contacting support@playgoon.com from the email associated with your account. We may verify identity and authority before acting.

Account deletion removes substantial account-linked data from active systems but may not immediately remove shared messages, games, groups, tournament results, moderation or safety records, backup copies, historical records, or every Club-membership record. Records may remain, be detached from the account, or be anonymized where reasonably necessary and permitted. The Privacy Policy provides additional detail.

For ordinary termination, PlayGoOn will provide 30 days’ notice when practical. For a curable material breach, PlayGoOn may provide 10 days to cure after notice. PlayGoOn may immediately suspend or terminate access for a credible safety threat, fraud, illegal conduct, harassment, serious or repeated violations, cybersecurity risk, material risk to PlayGoOn or others, a legal requirement, or a breach that cannot reasonably be cured. Immediate temporary suspension may be used while a credible concern is investigated.

Sections that by their nature should survive termination will survive, including ownership, licenses needed for retained records, external payment obligations, disclaimers, liability limits, indemnity, and dispute terms.

17. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” PLAYGOON DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.

PLAYGOON DOES NOT WARRANT THAT THE SERVICE OR ANY USER, TRAINER, CLUB, FACILITY, ACTIVITY, CREDENTIAL, LISTING, MAP, MESSAGE, OR THIRD-PARTY SERVICE WILL BE ACCURATE, SAFE, AVAILABLE, SECURE, ERROR-FREE, OR SUITABLE. NOTHING IN THESE TERMS EXCLUDES A WARRANTY THAT CANNOT LAWFULLY BE EXCLUDED.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTERWEBX LLC AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE, USER CONDUCT, IN-PERSON ACTIVITIES, THIRD-PARTY SERVICES, OR THESE TERMS.

This section does not exclude or limit liability that cannot lawfully be excluded or limited, including any responsibility imposed by applicable law. It does not state that PlayGoOn can never be sued, does not eliminate access to a court, and does not predetermine how a court will apply these provisions. These Terms do not establish a fixed monetary liability cap.

19. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Interwebx LLC and its affiliates, owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable legal fees to the extent caused by your User Content, activities, services, facility, external transactions, violation of these Terms or law, infringement of rights, or misconduct. PlayGoOn may control the defense of a covered matter, and you will reasonably cooperate.

This section does not require you to indemnify a released party for that party’s own negligence, gross negligence, reckless or intentional misconduct, unlawful conduct, or liability that applicable law does not permit another party to shift.

20. Dispute resolution; no arbitration requirement

The parties may attempt to resolve a dispute informally by sending a written description of the dispute and requested relief to support@playgoon.com and Interwebx LLC, 3020 Girvan Drive, Land O’ Lakes, FL 34638. Informal discussion does not waive a limitation period or right to seek immediate relief.

These Terms do not require arbitration, do not name an arbitration provider, and do not include an arbitration opt-out or class-arbitration provision.

21. Governing law and venue

These Terms are governed by Florida law, without regard to conflict-of-laws principles. Subject to any jurisdiction or venue right that applicable law does not permit a user to waive, the parties consent to exclusive jurisdiction and venue in the appropriate Florida state courts serving Pasco County, Florida, or the United States federal courts serving Pasco County, Florida.

22. Changes to the Service or Terms

PlayGoOn may modify, suspend, or discontinue Early Access or any feature. We may also update these Terms. We will post the updated version and effective date and provide additional notice when required by law. A material change will not bind a user until any acceptance required by law or the Service has occurred. Future paid plans are also subject to the advance-notice and express-agreement requirements in Section 11.

23. General terms

These Terms and incorporated policies are the entire agreement regarding the Service, except for a signed supplemental agreement. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Interwebx LLC may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law. Headings are for convenience. Electronic communications and acceptance may satisfy writing and signature requirements where permitted.

When you accept these Terms, PlayGoOn records your account ID, role or context, document ID and version, effective date, time of acceptance, explicit action, application version, and applicable superseded or withdrawn status. The Privacy Policy describes retention and related processing.
